Do companies have specific obligations to ‘protect people belonging to the LGBTI Collective’?

Well, the answer is linked to the size of the companies.

According to the provisions of Law 4/2023, Article 15 stipulates that all companies with more than 50 employees, as of March 4, 2024, must have a set of measures and resources in place to ensure real and effective equality for LGBTI individuals.

Although the law came into effect on March 1, 2024, we are awaiting the publication of the Regulation which will develop the action protocol, to be agreed upon with the legal representation of the workers.

Likewise, in that protocol, the types of measures to be implemented to prevent any type of harassment or violence against LGBTI individuals must be specified.

If the measures or protocol are not complied with the labor inspection can impose sanctions.
